Terms and Conditions
Retailers
We are delighted with your interest in MagNeckies jewelry designs for your retail locations. We look forward to having you become a member of MagNeckies family of retail stores.
With your application and acceptance to become a member of MagNeckies family of retail stores you agree to abide by the following Terms and Conditions at all times:
Acceptance of Terms
MagNeckies has the right to change the Terms and Conditions at any time without written notice. This includes restricting or denying further service to you or your company. When possible you will be given prior warning at the email address you have provided to MagNeckies.
Application Requirements
All applicants must provide a valid company name, contact name, mailing address, telephone number and email address. You also agree to keep this information up-to-date with MagNeckies at all times.
To activate your MagNeckies account you are required to email or fax a valid State Resellers Permit, Sales and Use Tax ID, a Certificate of Authority or similar document in conjunction with your application. The name of the document referred to above may vary from state to state.
Privacy Policy
MagNeckies does NOT release your personal information to third parties. However, MagNeckies may disclose the Reseller’s identity and contact information, if we suspect that the seller created fraudulent sales, or if requested by a government or law enforcement body, an injured third party, or as a result of a subpoena or other legal action, and MagNeckies shall not be liable for damages or result s thereof and Reseller agrees not to bring any action or claim against MagNeckies for such disclosure.
Retail Marketing and Sales Requirements
MagNeckies jewelry design products may only be sold in the retail store or from the website listed on your application. MagNeckies jewelry design products may NOT be listed on eBay, Etsy, ecrater, websites with “adult” content or similar sites.
You may NOT market MagNeckies jewelry design products as your own. The marketing terms for retail use include MagNeckies, MagNeckies ™, and MagNeckies ™, LLC combined with the product names of Bottle Caps, Disc Designs, Glass Tiles, Leather Flowers, and Accessories.
MagNeckies will provide you logos, titles and pictures of our products to be used responsibly by retailers. The pictures and titles may only be used on your listed website, saved on your computer, and then uploaded to your server. Hotlinking, linking pictures or objects from one website to another website, is NOT allowed and grounds for immediate termination of your account.
All item descriptions for use on your website must be written in your own words. This policy ensures protecting search engine optimization (SEO) standings for your website and MagNeckies’ website.
Product Characteristics
Expect slight variations in each handcrafted piece ordered. The distinctive handcrafting adds to the unique charm and beauty of each piece. MagNeckies jewelry design pieces are all handcrafted in Alpharetta, GA.
MagNeckies products are water resistant, NOT water proof. Prolonged exposure to water caused by taking baths, showers or swimming will cause product damage.
Please be aware of product suitability and use for young children. Parts used for necklaces, bracelets, and accessories include pendants and strong magnets that are small enough to swallow and may constitute a choking hazard.
Orders and Shipping Policies
MagNeckies requires minimum orders of $100. Orders for new retail store member starter kits are shipped within 3-4 weeks of order receipt. When starter kit orders exceed 10 per show or event shipping may take up to 6 weeks. Restocking orders for established retail store members are shipped within7-10 days of order receipt. MagNeckies endeavors to deliver.
All MagNeckies orders are insured and shipped using the United States Postal Service (USPS) and/or Federal Express (FedEx). You will be notified by telephone when the order has shipped and provided a USPS delivery confirmation number or a FedEx tracking number. USPS delivery confirmation numbers only show up in their online system, after delivery has taken place. FedEx tracking numbers will be available for online tracking once entered into their delivery system.
Return Policy
MagNeckies will gladly replace goods which have been damaged in shipping or have failed due to defects in manufacturing. You must notify MagNeckies by telephone within 5 days of order delivery and return the product for verification. You will be reimbursed for 1st class mail and be given the option for replacement, exchange, store credit, or full refund.
Should one of your customers have an issue with a MagNeckies product, please notify us within 14 days of the product sale and return the product for verification of the issue. We will work with both you and your customer to resolve the problem appropriately based on the specific circumstances. MagNeckies is interested in keeping both you and your customers happy.
Limitation of Liability
You agree that MagNeckies shall not be held liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use or the inability to use the MagNeckies website and/or MagNeckies products.
Governing Law
You must NOT violate any laws in your jurisdiction (including but not limited to copyright, trademark, or other intellectual property rights) when marketing and/or selling MagNeckies jewelry design products. Select states may stipulate laws specific to age for use of this type of product mandating procedures for retail marketing and sales.
This Agreement shall be interpreted and construed according to, and governed by, the laws of Georgia, excluding any such laws of another jurisdiction. You agree to submit to the exclusive jurisdiction of the courts location with the county of Fulton, Georgia to resolve any legal matter arising from the terms.
